Terms of Sale (Conditions Générales de Vente)

1. Scope of Application (Champ d’Application)
These Terms of Sale govern all orders placed on the Botā website (www.bota-care.com) and form the contractual basis between Botā and the customer. By placing an order, the customer agrees to these terms without reservation.
2. Products (Produits)
Botā offers wellness and skincare products as listed on the website.
• Each product is described in detail with specifications and photos for reference purposes.
• Although we strive to provide accurate representations, slight variations in colours or packaging may occur.
3. Prices (Prix)
• All prices are listed in GBP/EUR/USD and include applicable taxes (VAT).
• Shipping fees are indicated separately at checkout.
• Botā reserves the right to modify prices without prior notice, but products will be billed based on the rates in effect at the time of order confirmation.
4. Orders (Commandes)
• Orders are placed directly on the website by selecting products and completing the checkout process.
• The customer must provide accurate information for order fulfilment.
• Botā reserves the right to cancel or refuse orders in cases such as payment failure or suspected fraud.
5. Payment (Paiement)
Botā accepts the following payment methods:
• Credit/Debit Cards (Visa, Mastercard, AMEX)
• PayPal, Klarna
All payments are securely processed.
6. Shipping and Delivery (Livraison)
• Products are shipped to France, Europe, UK, US and Canada.
• Estimated delivery time depend on destination - between 3 to 7 business days.
• Shipping costs vary based on destination and order size and are displayed during checkout.
Delays: While we strive to deliver within the stated timeframe, Botā is not liable for delays beyond our control.
7. Returns and Refunds (Retours et Remboursements)
Right of Withdrawal:
• Products must be returned unused, unopened, and in their original condition within 30 days. Return cost at the charge of the client.
Return Process:
• Contact contact@bota-care within 30 days to initiate the return.
• Return shipping costs are the customer’s responsibility unless the product is defective.
Refunds:
Refunds are issued within 14 days of receiving the returned product in compliance with return conditions.
8. Liability (Responsabilité)
• Botā is not responsible for any damage caused by improper use of the products.
• In the event of delivery errors or defective products, Botā’s liability is limited to replacement or refund.
9. Data Protection (Protection des Données)
Customer data is collected and processed in accordance with our Privacy Policy and the GDPR.
10. Force Majeure
Botā shall not be held liable for failure to fulfil its obligations due to unforeseen events or force majeure circumstances (e.g., natural disasters, strikes, etc.).
11. Governing Law and Dispute Resolution (Droit Applicable et Litiges)
These Terms are governed by French law. In case of disputes, efforts will be made to settle amicably. If no agreement is reached, jurisdiction belongs to the competent French courts.
